As Trump advisor Stephen Miller rightly stated on X, Moss’s decision effectively declares “all potential FUTURE illegal aliens on foreign soil” as part of a protected class with a supposed right to admission into the United States. This judicial overreach is staggering and represents an unprecedented attack on America’s ability to defend its borders and enforce its immigration laws.
The judge’s ruling also cynically exploits recent Supreme Court guidance. Following the Court’s decision in Trump v. CASA, lower courts were wisely limited in their ability to issue nationwide injunctions—except in certain narrow cases, including those involving certified class actions. Moss seized upon this technicality, certifying a sweeping class of migrants who may become subject to Trump’s proclamation in the future. By doing so, he not only undermines the will of the American people but also openly defies the spirit of the Supreme Court’s recent ruling.
Moss said Wednesday that Trump “lacks the inherent constitutional authority” to supplant federal statutes governing removals. “To hold otherwise would render much, if not most, of the INA simply optional,” he added in the 128-page opinion.
