Alexandria Ocasio-Cortez has always been a walking, tweeting liability for the Democratic Party. But this time, she may have gone too far—even for her. In what could become a $15 million mistake, AOC took to social media last week and flat-out called Donald Trump a “rapist.” Not “accused,” not “civilly liable,” not even the legally inaccurate “found liable for rape”—just “rapist.” Period. End of sentence.
There’s just one problem: Donald Trump has never been convicted of rape. Not in a criminal court. Not in a civil court. Not anywhere. And AOC, a sitting member of Congress, knows that—or at least she should. But in her blind hatred for Trump and her insatiable thirst for likes and retweets, she let her fingers get ahead of her brain.
This isn’t just political mudslinging. It’s defamation. And worse, it’s defamation with “actual malice,” the very standard established in the landmark Supreme Court case *New York Times v. Sullivan*—the threshold that must be met for a public figure like Trump to successfully sue for libel.
And here’s the kicker: Trump just did that to ABC News and George Stephanopoulos earlier this year. Remember that? In March 2024, Stephanopoulos accused GOP Rep. Nancy Mace of endorsing a “rapist,” referring to Trump, during a live ABC interview. He said, verbatim, “Judges and two separate juries have found him liable for rape.” That wasn’t true. Trump was found liable for sexual abuse in the E. Jean Carroll case—not rape. It was a civil case, not a criminal conviction. And guess what? Trump sued. And ABC reportedly settled for a whopping $15 million.
So what did AOC do just a few months later? She repeated the same falsehood—only she went further. She didn’t say “liable.” She didn’t say “accused.” She called Trump a “rapist” outright. That’s not just reckless; that’s textbook malice. As Sen. Mike Lee pointed out, “Even under the ridiculously lenient standards of *NY Times v. Sullivan*, you’ve managed to incur defamation liability.”
Now, let’s be clear: AOC is not stupid. She’s reckless, arrogant, and unserious—but not unintelligent. She knows the legal line. She just doesn’t care. Because in her world, Trump is evil incarnate, and anything goes when it comes to attacking him—even if it means slandering him with a crime he was never convicted of.
It’s the same arrogant double standard we’ve come to expect from the modern Left. These are the same people who screeched “no one is above the law” for four years straight. The same crowd that demanded Trump be frog-marched into prison over paperwork. But when one of their own breaks the law—whether it’s libel, incitement, or abuse of power—they shrug it off. It’s not hypocrisy to them; it’s strategy.
Well, not anymore. Because President Trump doesn’t just sit back and take it. He’s already proven he’ll fight back in court, and he’s already won. If ABC and Stephanopoulos had to pay $15 million for their lie, why should AOC get a pass?
And let’s not ignore the context here. AOC’s lie wasn’t just some offhand remark. It was part of a broader attack accusing Trump of covering up the Jeffrey Epstein files. That’s right—she’s tying Trump to Epstein, with zero evidence, and using a false rape accusation as her glue. That’s not just irresponsible; it’s slanderous.
Of course, none of this will make headlines in the legacy media. CNN won’t touch it. MSNBC will pretend it didn’t happen. The New York Times will find some way to spin it as “speaking truth to power.” But the facts are clear. Trump was never convicted of rape. AOC said he was. That’s defamation, plain and simple.
And if there’s any justice left, she’ll pay for it—literally.
So while the rest of the Democratic field tries to out-cringe each other with bad podcasts, incoherent interviews, and half-baked policy proposals, AOC has decided to go all-in on a legally actionable lie. That’s not bold. That’s not brave. That’s just dumb.
And it’s going to cost her.
