Kamala Harris — the woman who couldn’t win a single primary, couldn’t articulate a policy position without a teleprompter, and couldn’t beat Donald Trump even with the entire media establishment carrying her water — has found a new job. She’s now the hype woman for a dark money operation called Demand Justice that’s raising $18 million to oppose Supreme Court nominees who haven’t been nominated, for seats that haven’t been vacated, on a timeline that doesn’t exist.

That’s right. They’re pre-gaming a judicial confirmation fight that hasn’t happened yet. It’s like tailgating for a football game that hasn’t been scheduled at a stadium that hasn’t been built. But sure, give them $18 million.

Here’s how the scam works. Demand Justice — run by a guy named Josh Orton who apparently wakes up every morning furious that the Constitution exists — has put together a “multimillion-dollar effort to oppose potential Trump Supreme Court appointees before they happen.” Those are his words. Before they happen. They’ve earmarked $3 million just for the pre-fight, with another $15 million ready to deploy the moment a vacancy opens up.

And what are they spending that $3 million on right now, when there’s no vacancy and no nominee? Opposition research on people who might get nominated. Attack ads against judges who might be on a shortlist. Focus groups to figure out which scary words work best on suburban women. It’s a entire industry built on the word “might.”

The specific scenario they’re salivating over — and simultaneously terrified by — is the possibility that Justices Clarence Thomas, who’s 77, or Samuel Alito, who’s 76, might retire during Trump’s term. If either one steps down, Trump gets to replace a conservative with a conservative, which would be the most constitutionally normal thing to happen in Washington in the last decade. But to hear Demand Justice tell it, you’d think Trump was planning to replace Ruth Bader Ginsburg’s ghost with Alex Jones.

Harris herself put out a statement rallying Democratic donors to fight “additional justices” that might be nominated “before they happen.” Let that sink in. A former vice president of the United States is asking people to donate money to oppose hypothetical nominees to hypothetical vacancies. This is what passes for Democratic Party strategy in 2026 — fighting things that haven’t occurred yet because they’ve already lost every fight over things that have.

And they’re working with Indivisible, another far-left outfit that was born during the Trump resistance era and has been looking for a reason to exist ever since. Together, these two groups represent everything that’s wrong with the modern Democratic approach to the judiciary: they don’t want to win arguments, they want to prevent arguments from happening.

Remember, these are the same people who told us for years that “dark money in politics” was destroying democracy. They held hearings about it. They wrote legislation about it. They gave speeches with tears in their eyes about how anonymous donors were corrupting our sacred institutions. And now here they are, running an $18 million dark money operation to kneecap the constitutional appointment process, and nobody in the mainstream press thinks that’s worth mentioning.

The Washington Times editorial board got it right this week when they wrote that conservatives need to prepare for battle over Supreme Court nominations. But the battle isn’t really about qualifications or judicial philosophy. It never is with these people. The battle is about power — specifically, the left’s fury that they don’t have it.

They lost the Senate. They lost the White House. They lost the popular argument on virtually every major issue from immigration to crime to the economy. And the one institution where they thought they could stage a comeback — the Supreme Court — keeps issuing rulings they don’t like. So instead of winning elections and nominating their own justices, they’re spending $18 million to make sure nobody Trump picks ever gets a fair hearing.

Here’s what Demand Justice won’t tell their donors: even if Thomas and Alito both retired tomorrow and Trump nominated the two most conservative judges in America, the court’s ideological balance wouldn’t change. It would still be 6-3. The same 6-3 it’s been since Amy Coney Barrett was confirmed in 2020. They’re not fighting to change the balance of the court. They’re fighting to prevent Trump from getting credit for maintaining it.

That’s what $18 million buys you in liberal Washington — not a strategy, not a plan, not a path to victory, but the illusion of resistance. A bunch of press releases, some cable news hits, a few attack ads that run in markets where everyone already agrees with you, and a fundraising email that says “WE STOPPED THEM” even though nothing actually happened.

Meanwhile, Trump is appointing judges at every level of the federal judiciary, reshaping the courts for a generation, and doing it all while the left spends its money on focus groups about nominees who don’t exist.
