A Georgia appellate court this week put the 2020 election interference lawsuit against former President Donald Trump and his aides on hold following an appeal of a ruling allowing Fulton County District Attorney Fani Willis to continue with the case.
In a brief ruling, the Georgia Court of Appeals suspended the “underlying proceedings.” The hiatus and the October 4 preliminary hearing date virtually guarantee that a trial won’t begin before the November election.
Judge Scott McAfee found in March that the defendants had not established a conflict of interest because of Willis’s romantic relationship with Nathan Wade, her special prosecutor in the case. Nevertheless, the court objected to the “appearance of impropriety” and only permitted Willis to proceed upon Wade’s resignation. Resigning was her alternative choice.
In their appeal, Trump and several of his co-defendants demanded the removal of Willis from office and the dismissal of the case. They said that the lavishly lavished romanticism “cast a pall over these entire proceedings by creating an appearance of impropriety in this case.” Willis then insisted in a motion that there was “no basis” to review the lower court’s ruling.
The appeals court, which consented to hear the challenge a month ago, has until mid-March to render a decision, after which the losing party may request relief from the Georgia Supreme Court, according to an Associated Press story on Wednesday. CNN reported that Willis intended to hold the racketeering case trial prior to the 2024 election, but he has not yet set a date.
In the Georgia case, Trump and eighteen other defendants entered not-guilty pleas to a number of allegations. Now, four have accepted plea agreements. Willis filed an appeal against McAfee’s decision to drop six of the 41 charges brought against Trump and his co-defendants at the end of the previous month. The rejected charges’ “lack of detail concerning an essential legal element,” according to the judge, was “fatal.”
Trump, who is running for president again, has categorically rejected any misconduct in a number of instances. A judge postponed a federal case involving confidential materials indefinitely. A federal election case is pending before the Supreme Court, which is debating an immunity issue. Only one, a New York “hush money” case connected to the election, has reached trial. Last Thursday, a jury found Trump guilty on all counts. Trump has promised to challenge the ruling.
This year, Willis is running for reelection herself. Wade attended the victory celebration that night, after winning the Democratic primary last month. Consider me rattled, then.
