According to leaks, the DHS of President Biden and VP Kamala Harris is not collecting DNA from the millions of refugees who come to the U.S.-Mexico border.

More than twenty House and Senate Republicans have signed a message to Biden and Harris that includes whistleblower claims against DHS for supposedly not following the DNA Fingerprint Act that Congress passed in 2005.

The law says that federal agencies have to get DNA samples from people who have been arrested, charged, or guilty of a crime, as well as from foreigners who are being held by the federal government.

Former President Trump signed off on a rule in 2020 that made it certain that the law had to be followed. Former President Barack Obama’s DHS had not followed the law. Reporters say that Biden’s DHS has continued to break the law since then.

Republicans Researchers say that during Fiscal Year 2021, the Biden Administration only got DNA from 16% of the 1.9 million people that Border Protection and the Office of Field Operations (OFO) met.

“Further, only 37% of the 2.7 million people that CBP and OFO met in Fiscal Year 2022 had their DNA taken. Also, people who spoke out said that only 36% of the 2.3 million people that CBP and OFO met in the first three quarters of 2023 had DNA taken from them. More recently, protected whistleblower statements say that CBP officials visited US Border Patrol (USBP) processing centers in Tucson, Yuma, Casa Grande, and San Diego. However, DNA was not being taken at any of the centers they visited. This flagrant disregard for the law has been made worse by your failed border policies, which have led to an unprecedented increase in the number of encounters with illegal immigrants—over 10 million in only three and a half years, and that number doesn’t even include the estimated 2 million who crossed and were not caught.”

The Republicans point out that Biden and Harris’s failure to get DNA from refugees at the border has killed people.

They say that Victor Antonio Martinez-Hernandez, a member of the Salvadoran gang that they say raped and murdered Rachel Morin and was also linked to the murder of a woman in El Salvador, went across the border four times.
