Biden Supreme Court Nominee Could Be Blocked by GOP, Thanks to Little Known Rule

News broke yesterday that liberal Supreme Court Justice Stephen Breyer would be retiring at the end of this term. Leftists have been pressuring Breyer to retire for a while now, hoping he’d leave while there was a Democrat president in the White House. Yet he makes the decision at the very worst time, as Biden lurches from one catastrophe to another.

The odds that Biden’s handlers will pick a competent replacement are next to zero. The progressives that run the administration (poorly) will no doubt pick a hard leftist activist, who will try to use the court to push a radical agenda. Republicans in the Senate have already vowed a tough confirmation process, should Biden pick a “woke” nominee.

And it looks like a rule hashed out by McConnell and Schumer could freeze the entire process.

“If all 11 Republican members of the Judiciary Committee oppose Biden’s pick and all 11 Democrats back her, the nomination goes inert. The nomination doesn’t die, but it does get parked until a lawmaker—historically, the Leader of the party—brings it to the floor for four hours of debate,” the report added. “A majority of the Senate—51 votes, typically—can then put debate about the issue on the calendar for the next day. But that’s the last easy part. When the potential pick comes to the floor again, it’s not as a nomination. At that point, it’s a motion to discharge, a cloture motion that requires 60 votes. In other words, 10 Republicans would have to resurrect the nomination of someone already blocked in the Judiciary Committee.” [Source: Daily Wire]

It sounds complicated, but it’s straightforward. Because the Senate is split 50-50, committee assignments are split as well. If the 11 Republican members of the Judiciary Committee all oppose Biden’s pick, the nomination doesn’t move forward. Schumer would then have to take it to the full Senate floor for debate. But, if he can’t get 60 votes to overrule the Judiciary Committee’s decision, the nominee will not become a justice.

All this means is Republicans must stand together in opposition to Biden’s pick. We know his administration is going to find someone far-removed from the traditions and values of our country. Republicans cannot approve of a socialist being added to the Supreme Court. And, considering this is an election year when Republicans are eager to retake Congress, they will have good reason to oppose Biden’s pick.

I guess we’ll have to wait and see, though. Breyer hasn’t officially announced his retirement. We can be sure Biden’s administration is already scrambling to find a replacement. Hopefully, Republicans are strategizing now on how to prevent Joe from putting a villain onto the court.
