Former AG Bill Barr told FNC’s Martha MacCallum on Tuesday that the appointment of a “special master” to handle the sensitive materials seized at the former president’s house by a federal judge in Florida is a “mistake” and would probably be reversed on appeal.

“Former U.S. Attorney General Bill Barr: In any case, I concur with Andy, who this morning published a piece in the “National Review” that attempted to deconstruct the position. I believe the opinion to be incorrect. And I believe the government ought to file an appeal. It has a number of serious flaws.”

“The appointment of a special master won’t stand up, in my opinion. But even if it does, I don’t think it will significantly alter the course. In other words, I don’t think it really affects the game other than the possibility of a little rain delay.”

“However, I believe that the fundamentals of the case have been established, and that the government has very solid evidence of what it actually needs to assess whether charges are appropriate—namely, that government papers and classified material were taken and improperly handled. They are investigating because there is some evidence that suggests they were duped.”

“And none of it actually has anything to do with document content. It has to do with the presence of papers there, their classification, and the fact that subpoenas for them were issued but never fulfilled. But they don’t have to prove the content — you know, the exact counsel offered in the memo, for example — in order to succeed in this case.”
