New York Mask Mandate Struck Down by State Supreme Court

Things might be relatively back to normal in your neck of the woods, but in blue states, people are still living like it’s 2020. Many are still plagued with irrational fears about COVID-19. They refuse to leave their homes and cover their faces with filthy, useless scraps of cloth. Democrat-run states are intent on keeping their residents harassed, panicky, and devoid of liberty. In New York City, they demand you show proof you are vaccinated before you can even enter a building.

But the facts remain that COVID is here to stay. Pandemic-level tactics are not sustainable and it’s arguable whether they did anything in the first place. That’s being punctuated these days by the spread of omicron, which is much more contagious than previous strains, though far less deadly. Despite this, New York State continues to punish its residents with a needless mask mandate.

And the state Supreme Court has just given a ruling.

A New York state Supreme Court judge on Monday struck down Democrat Governor Kathy Hochul’s mask mandate for schools and public locations…

Hochul’s mask mandate was “violative of the State Administrative Procedure Act as promulgated and enacted and therefore null, void, and unenforceable as a matter of law,” the judge wrote, adding that it was also “violative of the Public Health Law as promulgated and enacted and therefore null, void, and unenforceable as a matter of law.” [Source: Daily Wire]

At the outset of the COVID panic, most governors gave themselves emergency powers to enact rules without going through legislatures. It’s been two years and some governors have refused to let go of these powers. They continue to act like dictators, using this “emergency” to push rules, violating state law and constitutions. But in New York, the highest court just struck down the governor’s needless and unconstitutional mandate.

The court ruled that the governor violated the law when she pushed a mandate without going through the state legislature. It wrote that for New York to demand residents to follow strict COVID procedures, it needed to pass a law. That would require the cooperation of state lawmakers, which might take a while.

There are probably more than a few New York state lawmakers that don’t want to pass a mask mandate. They might even want to, you know, have their input considered? The whole, democratic process and all that? That’s certainly not what power-hungry governors like Hochul want—even though that’s the very reason we designed our governments to work this way. We have courts and legislatures to ensure one person, like a governor, can’t rule us like a dictator.

This court ruling is a reminder of how much damage unchecked governors did to our country. Some raided churches. Others shut down schools for years. And many more exploited COVID to take millions, in some cases billions, of tax dollars and waste them on unrelated issues.

If you ask me, major changes need to be made to state laws to prevent this from happening in the future. State lawmakers need to revise the emergency powers granted to a governor, to ensure a single person can’t derail an entire state. Especially one as populous as New York.
