A dangerous loophole in our immigration system is putting America at risk, and it’s long past time we fixed it. Right now, foreign nationals can sneak in, have a baby on U.S. soil, and that child automatically becomes a U.S. citizen. This is what many call “birth tourism,” and it’s being used by our enemies, mainly China and Mexico, to build secret spy networks right here in the United States.
Thankfully, President Donald Trump is doing something about it. In January 2025, he signed Executive Order 14160, which stops giving automatic citizenship to children born in the U.S. to parents who are not citizens and not under full U.S. jurisdiction. This isn’t just about immigration—it’s about national security.
Now the U.S. Supreme Court is considering the case Trump v. Barbara, which will decide whether President Trump’s order stands. One of the strongest voices supporting the President is Joshua Steinman, a former National Security Council official and Iraq War veteran. He filed a legal brief explaining exactly how dangerous this loophole really is.
Steinman’s point is simple: enemies of the United States are using birthright citizenship to their advantage. They send pregnant women into the U.S., sometimes legally, sometimes illegally. These women give birth here, and their children automatically become American citizens. That baby, born here but raised with foreign loyalties, grows up with all the rights of a citizen—including access to our schools, our government jobs, and even our military.
Think about it. A child born to Chinese nationals in America could later return to China, be trained by the Chinese Communist Party, and then come back here as a U.S. citizen. They could work in sensitive areas of government, business, or defense without raising a single red flag. That’s not just a theory; it’s already happening. And our enemies know it.
This isn’t what the Founders intended when they wrote the 14th Amendment. The phrase “subject to the jurisdiction” was never meant to include foreign nationals who owe their loyalty to another country. It was written after the Civil War to ensure that freed slaves were recognized as U.S. citizens—not to hand out citizenship like candy to anyone who steps across the border.
President Trump understands this. He knows that citizenship is not just a piece of paper—it’s a sacred bond between the individual and the nation. It means loyalty, responsibility, and respect for our laws. And that bond must be earned, not stolen through a legal trick.
The left, of course, is outraged. They claim Trump is attacking the Constitution. But they’re wrong. He’s defending it. He’s restoring the original meaning of the 14th Amendment and protecting American security in the process.
Too many politicians in Washington have ignored this threat for too long. They were more worried about political correctness than protecting the American people. But now, under strong leadership, we finally have a chance to close this loophole and defend our nation from within.
The Supreme Court must uphold President Trump’s executive order. Birthright citizenship should only apply to those who are truly under U.S. jurisdiction—meaning people who owe their full allegiance to America. Anything less is a gift to our enemies.
We must stop pretending that every person born on U.S. soil magically becomes loyal to our country. That is not how loyalty works. That is not how citizenship works. And that is not how we keep America safe.
This is more than a legal case. It’s a fight for the future of our country. If we don’t stand strong now, we risk letting foreign powers plant more spies, more agents, and more influence right in our own backyard. President Trump is leading this fight, and patriotic Americans should stand with him.
Our borders are our first defense. Our laws are our shield. And our citizenship must never be handed out to those who do not truly belong.
